We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice, unless a longer retention period is required by law (such as tax or accounting requirements). No purpose in this notice requires us to keep your personal information longer than the period during which you have an account with us. When we no longer have an ongoing legitimate need to process your information, we will delete or anonymize it, or securely isolate it if deletion isn't immediately possible (e.g., backup archives).

We have implemented appropriate technical and organizational security measures designed to protect your personal information. However, no electronic transmission or storage technology can be guaranteed 100% secure. Transmission of personal information to and from our Services is at your own risk.

8. Do We Collect Information From Minors?

We do not knowingly collect, solicit, or market to children under 18 years of age, nor do we knowingly sell such information. Opting out of marketing. You can unsubscribe from marketing emails at any time via the unsubscribe link, or reply STOP or UNSUBSCRIBE to SMS messages. No mobile information is shared with third parties or affiliates for marketing purposes. Text messaging originator opt-in data and consent is never shared with third parties.

Account information. To review, change, or terminate your account, contact us directly. Upon request, we will deactivate or delete your account, though we may retain some information to prevent fraud, troubleshoot problems, or comply with legal requirements.

Cookies. Most browsers accept cookies by default; you can set your browser to remove or reject cookies, though this may affect certain features of our Services.

10. Controls for Do-Not-Track Features

Most web browsers include a Do-Not-Track ("DNT") feature. No uniform technology standard for recognizing DNT signals currently exists, so we do not respond to DNT browser signals at this time. If a standard is adopted that we must follow, we will update this notice accordingly.

Global Privacy Control. We recognize and honor Global Privacy Control (GPC) signals. Agreement to Our Legal Terms

We are Home on the Way ("Company," "we," "us," "our"), a company registered in Indiana, United States, at 45 W Fall Creek Pkwy S Dr, Suite 5, Indianapolis, IN 46208.

We operate the website homeontheway.com (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

5. Products

We make every effort to display product colors, features, specifications, and details as accurately as possible, but we do not guarantee accuracy, and your display may not reflect actual product details. All products are subject to availability. We reserve the right to discontinue any product at any time, and prices are subject to change.

6. Purchases and Payment

We accept Visa, Mastercard, American Express, Discover, and PayPal. You agree to provide current, complete, and accurate purchase and account information, and to promptly update your payment information as needed. Sales tax will be added where required, and all payments are in US dollars. We reserve the right to correct pricing errors, refuse any order, and limit quantities purchased per person, household, or order — including orders that appear to be placed by dealers, resellers, or distributors.

7. Subscriptions

Billing and Renewal. Your subscription will continue and automatically renew unless cancelled. You consent to recurring charges to your payment method without prior approval for each charge, until you cancel. The billing cycle is monthly.

Free Trial. We offer a [NUMBER OF DAYS]-day free trial to new users who register with the Services. The account will be charged according to the user's chosen subscription at the end of the free trial.

Cancellation. You can cancel your subscription at any time by logging into your account. Cancellation takes effect at the end of the current paid term. Questions can be sent to [email protected].

Fee Changes. We may change the subscription fee from time to time and will communicate any price changes in accordance with applicable law.

8. Return/Refunds Policy

All sales are final and no refund will be issued.

9. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make them available, and may not use the Services for any commercial endeavor except those specifically endorsed by us. As a user, you agree not to, among other things:

• Systematically retrieve data to create a collection, compilation, or database without written permission
• Trick, defraud, or mislead us or other users, including attempts to learn sensitive account information
• Circumvent, disable, or interfere with security-related features of the Services

• Decipher, decompile, disassemble, or reverse engineer any Services software

10. User Generated Contributions

The Services may invite you to chat, contribute to, or participate in blogs, message boards, and other functionality, allowing you to post content ("Contributions"). Contributions may be viewable by other users and through third-party websites. When you post Contributions, you represent and warrant that they don't infringe third-party rights, that you own or have the necessary rights and licenses to grant our use of them, that they are not false or misleading, not unsolicited advertising or spam, not obscene or objectionable, don't violate any law, and don't involve minors inappropriately. Violation of these terms may result in termination or suspension of your rights to use the Services.

11. Contribution License

By posting Contributions, you automatically grant us an unrestricted, irrevocable, perpetual, worldwide license to host, use, copy, reproduce, publish, and distribute such Contributions for any purpose, and to prepare derivative works from them. You waive all moral rights in your Contributions. We do not assert ownership over your Contributions — you retain full ownership — but we have the right, in our sole discretion, to edit, re-categorize, pre-screen, or delete Contributions at any time without notice, though we have no obligation to monitor them.

The Services may contain links to other websites ("Third-Party Websites") or third-party content. We do not investigate, monitor, or endorse Third-Party Websites or Content, and are not responsible for their accuracy, appropriateness, or privacy practices. If you leave the Services to access a Third-Party Website, you do so at your own risk, and these Legal Terms no longer govern. Any purchases through Third-Party Websites are solely between you and that third party.

13. Services Management

We reserve the right, but not the obligation, to monitor the Services for violations of these Legal Terms, take legal action against violators, restrict or disable access to any Contributions, remove excessive or burdensome files, and otherwise manage the Services to protect our rights and facilitate proper functioning.

14. Privacy Policy

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. The Services are hosted in the United States. If you access the Services from another region with data laws differing from the United States, your continued use constitutes consent to transfer and process your data in the United States.

These Legal Terms remain in effect while you use the Services. We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Services to any person for any reason, including breach of any representation, warranty, or covenant in these Legal Terms. We may terminate your account or delete any content you posted at any time, without warning, in our sole discretion. If terminated, you are prohibited from registering a new account under your name or any other name, and we reserve the right to pursue civil, criminal, and injunctive relief.

16. Modifications and Interruptions

We reserve the right to change, modify, or remove Services content at any time without notice, and to modify or discontinue all or part of the Services. We are not liable for any modification, suspension, or discontinuance. We cannot guarantee the Services will be available at all times and are not liable for any loss or inconvenience from downtime or interruptions.

17. Governing Law

These Legal Terms and your use of the Services are governed by the laws of the State of Indiana, applicable to agreements made and entirely performed within Indiana, without regard to conflict of law principles.

18. Dispute Resolution

Binding Arbitration. If the Parties are unable to resolve a dispute through informal negotiations, the dispute will be finally resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA), and where appropriate, the AAA Consumer Rules. You understand that without this provision, you would have the right to sue in court and have a jury trial. Arbitration will take place in Indiana. If a dispute proceeds in court instead, it will be commenced in the state and federal courts located in Indiana, and the Parties waive defenses of lack of personal jurisdiction and forum non conveniens. No dispute may be commenced more than one (1) year after the cause of action arose.

Restrictions. Any arbitration is limited to the dispute between the Parties individually — no arbitration may be joined with another proceeding, brought on a class-action basis, or brought in a representative capacity on behalf of the general public.

Exceptions to Arbitration. Disputes seeking to enforce or protect intellectual property rights, disputes arising from allegations of theft, piracy, invasion of privacy, or unauthorized use, and any claim for injunctive relief are not subject to the arbitration provisions above.

19. Corrections

There may be information on the Services containing typographical errors, inaccuracies, or omissions. We reserve the right to correct these and to change or update information at any time without prior notice.

20. Disclaimer

The Services are provided on an as-is and as-available basis. Your use of the Services is at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranties about the accuracy or completeness of the Services' content, and assume no liability for errors, personal injury or property damage resulting from your use, unauthorized access to our servers, interruptions in transmission, bugs or viruses transmitted through the Services, or third-party products or services advertised through the Services.

21. Limitations of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, or loss of data, arising from your use of the Services, even if advised of the possibility of such damages. Our liability to you for any cause whatsoever will at all times be limited to $168.00 USD. Certain state and international laws do not allow limitations on implied warranties or exclusion of certain damages, so some of these limitations may not apply to you.

22. Indemnification

You agree to defend, indemnify, and hold us harmless — including our subsidiaries, affiliates, officers, agents, partners, and employees — from any loss, damage, liability, or claim, including reasonable attorneys' fees, arising from your Contributions, your use of the Services, breach of these Legal Terms, breach of your representations and warranties, violation of a third party's rights, or any harmful act toward another user.

23. User Data

We maintain certain data you transmit to the Services to manage performance, along with data relating to your use of the Services. Although we perform routine backups, you are solely responsible for all data you transmit, and we have no liability for loss or corruption of such data.

24. Electronic Communications, Transactions, and Signatures

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that electronic agreements, notices, and records satisfy any legal requirement that such communications be in writing, including electronic signatures, contracts, and orders.

25. SMS Text Messaging

Program Description. By opting into any Home on the Way text messaging program, you expressly consent to receive SMS messages to your mobile number, which may include marketing communications, appointment reminders, and responses to inquiries.

Opting Out. Reply "STOP" to any text to stop receiving SMS messages. You may receive a confirmation message. To rejoin, sign up again as you did the first time.

Message and Data Rates. Message and data rates may apply, determined by your carrier and mobile plan. Carriers are not liable for delayed or undelivered messages.

26. California Users and Residents

27. Miscellaneous

These Legal Terms and any policies or operating rules posted on the Services constitute the entire agreement between you and us. Our failure to enforce any right or provision does not operate as a waiver. We may assign our rights and obligations to others at any time. If any provision is found unlawful or unenforceable, it is deemed severable and does not affect the remaining provisions. No joint venture, partnership, employment, or agency relationship is created between you and us by these Legal Terms.

Subscriptions. If you subscribe to our Services, you agree that you may not, except if expressly permitted: modify, copy, redistribute, publish, display, or retransmit any portion of the Services without our prior written consent; reconstruct or attempt to discover source code or algorithms by any means; provide or make the Services available to any third party; intercept data not intended for you; or damage, reveal, or alter any user's data or related hardware, software, or information.

AI Products

When you use the AI Products provided by Home on the Way, you warrant that you will not:

• Deploy AI techniques that use subliminal, manipulative, or deceptive methods designed to distort behavior and impair informed decision-making, particularly where this causes significant harm
• Exploit vulnerabilities related to age, disability, or socio-economic circumstances through AI in a way that distorts behavior or decision-making
• Use AI systems for biometric categorization that infer sensitive attributes such as race, political opinions, religious beliefs, or sexual orientation, except in narrow, lawful cases
• Implement AI-based social scoring systems that evaluate individuals or groups in a manner causing harm, discrimination, or unfair treatment
• Assess the risk of someone committing a criminal offense based solely on profiling or non-behavioral factors, except within narrowly defined legal safeguards
• Compile facial recognition databases through untargeted scraping of images from the internet, social media, or CCTV footage
• Use AI to infer emotions in sensitive environments such as workplaces or educational institutions where it could lead to discrimination or privacy violations
• Engage in real-time remote biometric identification in public places for law enforcement purposes, except with strong legal justification and oversight

Artificial Intelligence

We recognize the significant impact AI can have on our users and society, and are dedicated to ensuring our AI Products are designed and operated in a manner that aligns with comprehensive ethical standards — upholding fairness, transparency, and accountability. This section applies to all AI-powered features, services, and systems in our Services, and governs their development, deployment, and use to protect users' rights. It applies to all stakeholders, including employees, third-party vendors, and partners who interact with our AI Products.

Enforcement. Any misuse of our AI Products or failure to adhere to these standards will result in appropriate action to protect the integrity of our platform and our users. Violations may include: engaging AI Products in ways that violate user privacy or disregard ethical guidelines; deploying AI in a manner that introduces bias or unfair treatment; improper handling or storage of data by AI Products; or using AI in a way that compromises system or user security. • Temporary Suspension — access to AI Products or platform features suspended while an issue is investigated
• Termination of Access — permanent termination for serious violations, particularly those causing user harm or breaching privacy regulations
• Legal Action — pursued where misuse leads to significant harm, data breaches, or legal violations, including referral to law enforcement or regulators
• Public Disclosure — for incidents impacting public trust or involving severe ethical breaches

Commitment to Responsible AI. Beyond the consequences above, we are committed to repairing any harm caused by misuse of AI, correcting biased outcomes, and implementing additional safeguards to prevent future violations. We will regularly review and update this Policy to reflect technological advancements and legal changes related to AI ethics and regulation.

Contributions

"Contributions" means any data, information, text, code, music, scripts, sound, graphics, photos, videos, tags, messages, interactive features, or other materials you post, share, upload, or submit through the Services, or any other content or data you provide to us or use with the Services.

We may, but are under no obligation to, review or moderate Contributions, and we expressly exclude liability for any loss or damage resulting from a user's breach of this Policy. Please report any Contribution you believe breaches this Policy — we determine, in our sole discretion, whether it does.

Reporting a Breach of This Policy

We may, but are under no obligation to, review or moderate Contributions and expressly exclude liability for any resulting loss or damage. If you believe a Service, Content, or Contribution breaches this Policy or infringes third-party intellectual property rights, email us at [email protected] with details of what's in breach and why. You can also send detailed feedback on interactions with our AI Products to the same address, including the context, nature of the concern, and any relevant screenshots or documentation. We will reasonably determine whether a breach has occurred.

Consequences of Breaching This Policy

Consequences vary depending on the severity of the breach and your history on the Services. In some cases we may issue a warning and/or remove the infringing Contribution; for serious or repeated breaches, we may suspend or terminate your access and disable your account. We may notify law enforcement or pursue legal proceedings where we believe there is a genuine risk to an individual or a threat to public safety. We exclude liability for any action taken in response to a breach of this Policy.

Complaints and Removal of Legitimate Content

If you believe Content or a Contribution was mistakenly removed or blocked, contact us using the details below and we will promptly review the decision. The Content or Contribution may remain down while we conduct the review.
